This Pickup Soccer Waiver & Terms is specific to participation in pickup soccer games and operates in addition to the general Terms & Conditions of coachdanielpt.com. This Pickup Soccer Waiver & Terms (“Agreement”) applies to all individuals who register, pay for, attend, or otherwise participate in any pickup soccer games, events, or activities organized or hosted by Coach Daniel P / The Art of Football LLC (“Organizer”).
By registering and/or completing payment for a pickup game, you acknowledge that you have read, understood, and agreed to the terms below.
1. Assumption of Risk
You understand that participation in soccer and related athletic activities involves inherent risks, including but not limited to:
- Physical contact with other players
- Slipping, falling, or collision with people or equipment
- Injuries such as sprains, strains, fractures, concussions, or other serious harm
You voluntarily assume all risks, known and unknown, associated with participation, whether caused by your own actions, the actions of others, field conditions, weather, or any other circumstances.
2. Release of Liability
To the fullest extent permitted by law, you hereby release, waive, discharge, and hold harmless Coach Daniel P, The Art of Football LLC, its owners, officers, staff, volunteers, independent contractors, and affiliates from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to:
- Personal injury
- Property damage
- Loss or theft of personal belongings
- Illness or death
This release applies even if the injury or damage is caused by ordinary negligence.
3. Medical Responsibility
You confirm that:
- You are physically fit and able to safely participate in pickup soccer
- You have not been advised against participation by a medical professional
You agree that the Organizer has no responsibility to provide medical care. In the event of injury, you authorize the Organizer to seek emergency medical treatment if deemed necessary, and you accept full financial responsibility for any resulting medical costs.
4. Code of Conduct
Participants must conduct themselves in a respectful and sportsmanlike manner at all times.
The following behaviors are strictly prohibited:
- Physical or verbal abuse
- Fighting or threatening behavior
- Dangerous or reckless play
- Discrimination or harassment of any kind
Violations may result in immediate removal from the game and/or a permanent ban from future events without refund.
5. Payment, Cancellations & Refunds
- All pickup games are prepaid only
- No refunds for no-shows or late cancellations
- All sales are final
If a pickup game is canceled by the Organizer due to weather, field closures, or other safety concerns, players will receive a credit toward a future pickup game. No cash refunds will be issued.
6. Attendance & Punctuality
You are responsible for arriving on time and prepared to play. Late arrivals may result in reduced playing time without refund.
The Organizer reserves the right to adjust teams, playing time, or format as needed to maintain game flow and fairness.
7. Photography & Video Release
You grant the Organizer permission to photograph or record you during pickup games and to use such media for promotional, marketing, or educational purposes, including use on websites and social media, without compensation.
8. Personal Property
You acknowledge that the Organizer is not responsible for lost, stolen, or damaged personal property brought to the venue.
9. Governing Law
This Agreement shall be governed and interpreted according to the laws of the State of California.
10. Acknowledgment & Agreement
By registering and completing payment for a pickup game, you acknowledge that:
- You have read and understood this Waiver & Terms
- You are voluntarily giving up certain legal rights
- You agree to be bound by all terms stated above
If you do not agree to these terms, you must not register for or participate in pickup games.
